These Terms of Service ("Terms") govern your access to and use of the AgileAI Coach mobile application for iOS and Android and all related services (the "App"), operated by Gregory Keegan, trading as AgileAI.coach, a sole proprietorship at Tiefenseer Str. 3, 13439 Berlin, Germany. VAT-ID: DE451353850.
By downloading, installing, accessing, or using the App, you agree to these Terms. If you do not agree, do not install or use the App. Questions: contact@agileai.coach
To use the App you must be at least 18 years old (or the age of majority in your jurisdiction), have legal capacity to enter a binding contract, not be prohibited by applicable law from receiving services, and provide accurate, current, and complete registration information.
We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on a device you own or control, solely for personal or internal business purposes.
You may not copy, modify, distribute, sell, or lease any part of the App; reverse engineer or decompile it (except as permitted by mandatory applicable law); remove copyright notices; or violate App Store distribution rules.
If you downloaded the App from the Apple App Store: these Terms are between you and us only, not Apple Inc. Apple has no responsibility for the App or its content. Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
Subscriptions automatically renew at the end of each billing period unless you cancel at least 24 hours before expiry. App Store subscriptions are managed via App Store account settings. Direct subscriptions are managed via Account settings or by emailing contact@agileai.coach.
Right of withdrawal (consumers in Germany/EU): You have a statutory right to withdraw within 14 days of contract conclusion under §§ 312g, 355 BGB. This right expires under § 356(5) BGB once performance has begun with your express consent.
The App includes AI Features within scope of Article 50 of the EU AI Act. We disclose AI interaction in the App. AI Output may be inaccurate, incomplete, or misleading. It does not constitute professional advice. You are responsible for verifying AI Output before acting on it.
We do not deploy any AI Feature classified as a "prohibited practice" under Article 5 of the EU AI Act. We do not run AI sentiment classification or emotion inference on user responses, in compliance with Article 5(1)(f) of the EU AI Act.
We do not use your User Content to train foundation AI models without your explicit opt-in. We do not sell your personal data.
You may not use the App to violate applicable law; generate unlawful, defamatory, obscene, or discriminatory content; transmit malware; interfere with the App's integrity; gain unauthorized access; scrape data; impersonate others; or train competing AI models without our written consent.
The App, its design, code, trademarks, and all content created by us are owned by Gregory Keegan, trading as AgileAI.coach, protected by German copyright law (UrhG). You retain ownership of your User Content and grant us a limited license to process it solely to operate and improve the App.
THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW. Statutory warranties under German law (§§ 327 ff. BGB for digital products) remain unaffected.
Our total aggregate liability shall not exceed the greater of (a) EUR 100 or (b) total fees paid by you in the 12 months before the claim. We are not liable for indirect, incidental, special, consequential, or punitive damages. Nothing limits liability for death or personal injury caused by negligence, fraud, or liability that cannot be excluded under applicable law.
You can delete your account via the App (Profile → Account → Delete Account) or via our public deletion page. The process takes 7 days with a cancel option. See our Privacy Policy for full details on data retention.
We will notify you of material changes via in-App notification or email at least 14 days before the effective date. Continued use constitutes acceptance.
These Terms are governed by the laws of the Federal Republic of Germany, excluding CISG. The European Commission provides an ODR platform at ec.europa.eu/consumers/odr. Exclusive jurisdiction for business users: courts of Berlin, Germany.

Zur Nutzung der App müssen Sie mindestens 18 Jahre alt (oder volljährig in Ihrer Rechtsordnung) sein und die rechtliche Fähigkeit besitzen, einen verbindlichen Vertrag abzuschließen.
Wir gewähren Ihnen eine eingeschränkte, nicht ausschließliche, nicht übertragbare, widerrufliche Lizenz zur Installation und Nutzung der App auf einem Mobilgerät, das Sie besitzen oder kontrollieren, ausschließlich zu Ihren persönlichen oder internen Geschäftszwecken.
Bei Bezug aus dem Apple App Store: Diese Bedingungen werden ausschließlich zwischen Ihnen und uns geschlossen, nicht mit Apple Inc. Apple und seine Tochtergesellschaften sind Drittbegünstigte dieser Bedingungen.
Abonnements verlängern sich automatisch, bis Sie mindestens 24 Stunden vor Ablauf kündigen. Widerrufsrecht für Verbraucher: Sie haben ein gesetzliches Widerrufsrecht innerhalb von 14 Tagen ab Vertragsschluss gemäß §§ 312g, 355 BGB.
Die App enthält KI-Funktionen im Anwendungsbereich von Art. 50 EU-KI-Verordnung. KI-Ausgaben können ungenau, unvollständig oder irreführend sein und stellen keine fachliche Beratung dar. Sie sind für die Überprüfung verantwortlich.
Wir setzen keine KI-Funktion ein, die als "verbotene Praktik" nach Art. 5 EU-KI-Verordnung einzustufen wäre. Wir führen keine KI-Sentimentklassifizierung oder Emotionserkennung auf Nutzerantworten durch (Art. 5 Abs. 1 lit. f EU-KI-VO).
Wir verwenden Ihre Nutzerinhalte nicht zum Training von KI-Modellen ohne Ihre ausdrückliche Einwilligung. Wir verkaufen Ihre personenbezogenen Daten nicht.
Sie dürfen die App nicht nutzen, um gegen anwendbares Recht zu verstoßen, rechtswidrige Inhalte zu erzeugen, Malware zu übertragen, den Betrieb der App zu stören, sich unbefugten Zugang zu verschaffen oder Konkurrenz-KI-Modelle zu trainieren.
Unsere Gesamthaftung ist beschränkt auf den höheren Betrag von (a) EUR 100 oder (b) den von Ihnen in den 12 Monaten vor dem Anspruch gezahlten Gebühren. Gesetzliche Haftungsansprüche bleiben unberührt.
Sie können Ihr Konto über die App (Profil → Konto → Konto löschen) oder über unsere öffentliche Löschseite löschen. Der Vorgang dauert 7 Tage mit einer Abbruchoption.
Diese Bedingungen unterliegen deutschem Recht unter Ausschluss des UN-Kaufrechts (CISG). Plattform zur Online-Streitbeilegung: ec.europa.eu/consumers/odr. Ausschließlicher Gerichtsstand für Unternehmer: Gerichte Berlin, Deutschland.
